84-Year-Old Female Bicyclist Dead in Traffic Incident

November 19, 2020 Alan Ahdoot

A bicyclist was struck by a vehicle in Santa Clara on Thursday, November 5th. Santa Clara Police Department is the lead investigator in the case. The incident happened at around 2:00 p.m. on El Camino Real, near Kiely Boulevard. A red 2010 Ford Ranger was driving out of a parking area when the bicyclist hit the pickup truck. The bicyclist, who was later identified as an unnamed 84-year-old woman, was severely injured from the collision. The woman was brought to the hospital for treatment but succumbed to her injuries shortly after arrival. The driver of the pickup truck was found to not have been driving under the influence of either alcohol or drugs.

Can Wrongful Death Claims Be Filed on Behalf of Bicyclists?

Yes, they can. If a person was found dead due to an automobile incident, a wrongful death claim can be filed on their behalf by the next of kin or the beneficiary of their estates regardless of whether they were a pedestrian, a passenger, another driver, or even a bicyclist. However, the cause of death must be due to the crash and not caused by other medical conditions. Determining this usually requires a post-mortem medical examination.
