November 6, 2020 Alan Ahdoot

A female pedestrian who was struck by an unknown vehicle on September 30th in South Bakersfield died due to her injuries on October 11th. The pedestrian was identified as a 26-year-old woman named Rena Julian. She had been receiving further treatment for her injuries at Kern Medical since the date of the accident. The crash which eventually took her life occurred between South H Street and Vinca Court just before 11:00 p.m. It is unknown whether this incident was a hit-and-run. Kern County Sheriff Office is currently leading an investigation to her accident.

What Happens to a Personal Injury Claim if the Victim is Deceased?

If the plaintiff of a personal injury claim died during the process, the family member or the beneficiary of the deceased can continue the claim using a survival action claim. This allows the damages claimed to be continued as it is. As the next living kin, you can also choose to change the claim into a wrongful death claim. Although a wrongful death claim will cover certain damages that were not included in the original personal injury claim, it also removes certain damages.
