Can You File A Claim Against At-Fault Driver on Behalf of the Deceased?

Yes, you can. It is possible to file a claim against an at-fault driver even if the victim has already passed away. This legal action is usually done by the nearest kin of the victim. If the victim died because of the negligent actions of the at-fault driver, you can file a wrongful death suit against them or their insurance provider. You can do this regardless of whether the at-fault driver was arrested for their crimes.
