What Happens If the At-Fault Driver Dies Following A Crash?

In 2018, around 40% of California drivers die in car crashes – regardless of whether they were the at-fault driver or the victim. If you were involved in a crash where the driver who is responsible for the crash was fatally injured, you may be wondering – is it possible to pursue damages? After all, if you were also wounded in the crash, you are completely within your rights to seek legal action against the driver who was responsible. This is especially true if the driver was being negligent or, even worse, driving while intoxicated. It may relieve you to know that even if the driver is deceased, you can still pursue a claim against their auto insurance provider. It is also possible to file a suit against the beneficiary of the deceased’s estates.
