The Land Rover suddenly veered off-road and crashed with the divider wall and was overturned as a result. The vehicle was driven by a 19-year-old man and was carrying two passengers: his girlfriend, aged 18, and the younger brother of the driver, aged 13. The younger brother died from injuries sustained from the accident after the SUV was overturned. The driver and the girlfriend also suffered from some minor injuries.

Can A Family Member File A Personal Injury Claim Against Another?

Yes, they can. If one of your relatives caused injury or damages to you in an automobile accident and refuses to compensate you in spite of their action, then you have every right to pursue legal actions against them. In California, you can even file a personal injury claim against your spouse if they were the at-fault driver since spousal immunity does not apply in the state. To begin this process, you need to seek out a legal representative outside of the lawyers that you typically use as a family. You can contact us to get in touch with one of our attorneys and receive a free consultation for your case by calling (877) 871-3256.
