Male Pedestrian Dead After Crash in Bakersfield

October 24, 2020 Alan Ahdoot

A male pedestrian was struck by a vehicle in Bakersfield on Friday, October 16th, 2020. Bakersfield Police Department is the lead investigator of the case. They received information that the incident happened just past 6:00 a.m. at Union Avenue, near 19th Street. The pedestrian was crossing the road outside of a crosswalk on Union Avenue when he was hit by the oncoming vehicle. The driver of the yet to be identified vehicle remained at the scene. Authorities are still investigating the circumstances of the crash.

Can You Pursue A Claim Against A Negligent Pedestrian?

Theoretically, you can, although in practice this rarely happens. This is because you, as the driver, are generally expected to be more prudent and conscientious of traffic laws since pedestrians are more vulnerable to severe injuries or damages if a crash occurs. In fact, it is very possible that a driver who is not at fault to be sued by a pedestrian who disobeyed traffic laws! This doesn’t mean it isn’t possible to pursue a claim against a pedestrian, but you should consult an attorney first before choosing to take any action.
