September 20, 2020 Alan Ahdoot

On Thursday, September 17th, an accident was reported to have occurred at 11 p.m. in Lancaster. Los Angeles County Fire Department was the first responder at the scene. A motorcycle was one of the vehicles damaged in the crash, and its driver was pronounced dead at the scene. The cause of the incident is still under investigation.

Can You Claim A Death Benefit from a Motorcycle Fatality?

In 2017, NHTSA found that from all motorcycle-related traffic fatalities, 94% of those killed were drivers. With this extremely high death rate, you may be wondering, can you claim a death benefit from a motorcycle driver who died in a traffic accident?

If you were the beneficiary of the deceased and the person who died had auto insurance that includes personal injury protection (PIP), you should be able to claim the payout. However, if the traffic accident was due to another party’s fault, it would be much harder to also claim an insurance payout from the at-fault party.

This doesn’t mean it is an impossible task, however. We can provide you with the legal assistance to claim the death benefit that you should be entitled to as part of the victim’s family. If you’d like to get in contact with one of our lawyers today, call us at (866) 698-2306.
