Can Uninjured Victims File A Claim Against Injured At-Fault Driver?
In general, drivers are more likely to be fatally injured than passengers or pedestrians. Yet at the same time, more often than not, auto accidents are caused by the driver’s actions. Thus, even if you were in an auto accident where you are uninjured but suffered from economic or non-economic damages, you should still file a claim against the injured driver who is responsible for the crash. Also, be absolutely certain that you do not suffer any minor injuries that can become catastrophic injuries in the future. We recommend you visit the hospital to ensure this if paramedic treatment on the scene wasn’t adequate.
