October 23, 2020 Alan Ahdoot

On Thursday, October 15th, a fatal accident happened in Delano. California Highway Patrol received a report that a male tow truck driver was struck by a vehicle when he was helping another driver who had troubles with their vehicle. The accident occurred at nearly 10:00 p.m. on Highway 99, near Woollomes Avenue.

The tow truck driver, who is yet to be identified, was standing on the shoulder of the road when he was hit by an oncoming SUV driven by a 48-year-old man named Grant August Miller. The tow truck driver was pronounced dead at the scene, while Miller sustained some minor injuries. Authorities found that Miller was driving under the influence of drugs.

Can You Still File A Claim if At-Fault Driver Is Convicted for A DUI?

Yes, you can. If a driver is arrested for driving under the influence, it doesn’t mean that you can’t pursue a claim against them or their insurance provider for their actions. This is because a claim will be processed in a civil court, while a DUI charge will be processed in a criminal court. There is a possibility of being able to claim a full damages payout based on what you file if the driver receives a conviction. However, this isn’t guaranteed. If you’d like to know more about what you can do to ensure that you can receive the full amount to your claim, call us at (800) 310-1606 for a free consultation.
