Can You Still File A Claim if At-Fault Driver Is Convicted for A DUI?
Yes, you can. If a driver is arrested for driving under the influence, it doesn’t mean that you can’t pursue a claim against them or their insurance provider for their actions. This is because a claim will be processed in a civil court, while a DUI charge will be processed in a criminal court. There is a possibility of being able to claim a full damages payout based on what you file if the driver receives a conviction. However, this isn’t guaranteed.
