Train Struck Pedestrian Dead in LA

November 1, 2020 Alan Ahdoot

A person was struck dead by a Metro train in downtown Los Angeles on Wednesday, October 21st. The incident occurred just after 7:00 p.m. on the tracks between the stations of 7th Street/Metro Center and Westlake/MacArthur Park. The individual’s identity was not disclosed by the authorities and investigation of the incident was still ongoing.

Who Should be the Recipient of a Wrongful Death Claim in a Train Accident?

The Federal Railroad Administration reported that in 2018, more than 700 people have died from a train-related accident in California. With this rather high rate of fatality, what can you do if your loved one was one of them? Can you pursue a wrongful death claim?

The answer is yes, you can. If you want to pursue a wrongful death claim on behalf of your loved one following their passing from a train accident, you will need to start filing for a ‘notice of claim’ within 90 days since the accident. This is imperative since you will be filing a wrongful death claim against a governmental entity, which is the agency responsible for operating the trains that took the life of your loved one. You must consult a lawyer if you plan to file a claim against the state, local, or even federal government responsible. Call us at (800) 310-1606 to get a free consultation, available 24/7.
